JUSTICE PURNENDU SINGH ORAL ORDER 23-11-2021 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. Petitioner seeks regular bail in connection with G.R. Case No. 1537 of 2019 arising out of Korha P.S. Case No. 120 of 2019 registered for offences punishable under Section 376 of the I.P.C. and Section 4 of the POCSO Act.

This Court vide order dated 05.10.2021, called for a report regarding the current stage of trial from the Court of learned A.D.J. 1st -cum-Special Judge Katihar, District-Katihar. In compliance of the said order, report contained in letter no. 149 dated 09.10.2021 has been sent by the A.D.J. 1st -cum-Special Judge Katihar, District-Katihar informing that out of seven witnesses, one witness has been examined and against rest six, bailable warrant has been issued on 28.09.2021.

Patna High Court CR. MISC. No.16456 of 2021(4) dt.23-11-2021 2/2 Considering the facts and circumstances and the progress of the trial in this case, I am not inclined to release the petitioner on bail at this stage.

If the petitioner, if so advised may renew the prayer for bail if the trial is not concluded within a period of nine months from the date of the order.
