ANJANA PRAKASH ORAL JUDGMENT Date: 21-06-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks revision of the Judgment of conviction dated 11.2.2016 passed by the 1st Additional Sessions judge, Khagaria, in Criminal Appeal No. 47 of 2013 by which he has affirmed the order dated 31.7.2013 passed by Sri Anjani Kumar Gond, Judicial Magistrate, 1st Class, Khagaria, in G.R. No. 1270 of 2010, Trial No. 1496 of 2013 arising out of Khagaria (Muffasil) P.S. Case No. 331 of 2010, by which he has convicted the Petitioner under Section 25(1-B)a and 26(1) of the Arms Act and sentenced him to undergo rigorous imprisonment for three years and a fine of Rs.5,000/- in default of which further six months rigorous imprisonment.
Patna High Court CR. REV. No.427 of 2016 dt.21-06-2016 2/2 Having gone through the Judgment of conviction, I do not find any merit in the application.
However, considering the period of custody and the date of occurrence, the sentence is reduced to the period already undergone by the Petitioner.
With the aforesaid observations, the application stands dismissed.
