The petitioners have preferred this application for grant of regular bail in a case registered under sections 353, 332, 188 and 34 of the Arms Act and section 27 of the Arms Act.

As per the prosecution case, it is stated by the informant that the two accused persons who are the petitioners herein made an attempt to cross over the border into Nepal on their motorcycle but due to COVID-19 Pandemic restrictions were stopped from doing so by the security personnel. Thereafter, it is stated that to spread fear they fired in the air and taking benefit of the bushes, they managed to escape.

No.16498 of 2021(4) dt.22-11-2021 2/2 It is submitted by learned counsel for the petitioners that the allegations as levelled against the two petitioners are false and concocted. They have been falsely implicated in the case because of their antecedent. They are in custody since 15.6.2020 and 8.4.2020 respectively and investigation in the case has concluded Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioners having remained in custody for over 1 year, the Court directs the two petitioners to be enlarged on bail in connection with Jaynagar P.S. Case no. 113 of 2020 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Madhubani/In-charge Successor Court.
