The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 427, 354(A), 308, 504 and 506/34 of the Indian Penal Code.

It is a case of assaulting due to which informant has sustained injuries and specific allegation against the petitioner is that he assaulted to the informant by means of Tengari. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is case and counter case between the parties and both parties have sustained injuries as alleged in separate incident. Annexure-3 is injury report of the informant

Patna High Court CR. MISC. No.5968 of 2022(2) dt.03-08-2022 2/2 showing that lacerated and abrasion wound were sustained by the informant caused by hard and blunt substance. It is also submitted that the injury report is not consonance with the prosecution case. Petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Darbhanga in connection with Baheri P.S. Case No. 119 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
