The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 419 of the Indian Penal Code.

As per the prosecution case, petitioner collected Rs. 500/- from several beneficiaries for getting them benefit of PM Kisan Samman Nidhi Yojana.

It is submitted that petitioner is a social worker and is in inimical term with the press reporter Uday Kishore Sahand and to take revenge from the petitioner, the informant lodged this false and concocted case. None of the beneficiaries has paid any single farthing to the petitioner, so Section 420 of IPC is not applicable. Petitioner claims clean antecedents.

No.5265 of 2023(2) dt.09-05-2023 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Banka in connection with Jaipur P.S. Case No. 61 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
