JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Rajapakar P.S. Case No. 89 of 2012 registered under Section 302/34 of the Indian Penal Code.

The accusation of informant is that the marriage of his daughter was performed with the petitioner before 15 years and out of the wedlock there were one female child. After passing over eight years, petitioner performed re-marriage with another lady, namely, Anjali Devi. On 15/6.05.2012, informant received information on telephone that his daughter was killed by her husband and in-laws by pressing her neck.

Learned counsel for the petitioner submits that

No.19662 of 2016 (3) dt.13-07-2016 petitioner is the husband of the deceased and the marriage was performed before 15 years and out of the wedlock there were one female child, whose age is about 12 years. It is further submitted that the deceased, wife of the petitioner, committed suicide in annoyance due to exchange of word with family members of the petitioner. It is further submitted that the petitioner is in custody since 27.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VII, Vaishali at Hajipur, in connection with Raja Pakar P.S. Case No. 89 of 2012. Out of two sureties, one surety must be the close relative of the petitioner.
