The petitioner seeks bail in Sessions Trial No. 326 of 2014, arising out of Pipra Kothi P.S. Case No. 100 of 2013, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

The prayer for bail of the petitioner was earlier twice rejected. Firstly on 12.01.2015 passed in Cr. Misc. No. 31267 of 2014 and secondly on 23.09.2015 passed in Cr. Misc. No. 39099 of 2015 with a direction to conclude the trial within six months. If the trial is not concluded within the stipulated time, the petitioner may renew his prayer for bail.

It is submitted that there was case and counter case. The

Patna High Court Cr.Misc. No.17879 of 2016 (2) dt.31-08-2016 2/2 petitioner is alleged to have fired which hit the deceased. The true fact is that there was no intentional fire. The petitioner and others were quarreling with each other.

Considering the facts aforesaid and the fact that the petitioner is in jail since 10.01.2014 and he has already remained in jail for more than 2 1⁄2 years, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 12th Additional Sessions Judge, East Champaran, Motihari in Sessions Trial No. 326 of 2014, arising out of Pipra Kothi P.S.
