Petitioner is accused in connection with Sasaram (Town) P.S. Case No.481 of 2015 registered under Section 365 of the I.P.C.

The accusation is that Basukinath Singh, brother-inlaw of the informant was disappeared in course of going to Asansol from Varansi regarding which information was given to G.R.P. Varanasi. In course of inquiry, his mobile location was found at Sasaram in the night of 23.03.2010. The house of Lali Chauhan, neighbour of Basukinath Singh, was raided by Narcotic Control Bureau. In that course, Lali Chauhan fled away but his

Patna High Court Cr.Misc. No.17888 of 2016 (2) dt.03-05-2016 2/2 wife was arrested. Thereafter, they were in impression that at the instance of Basuki Nath Singh raid was conducted in their house. On enquiry of calls detail of Basuki Nath Singh, it was found that this petitioner also talked at the mobile of Basuki Nath Singh on 23.03.2010.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that while the written report is given on 16.05.2010 but the F.I.R. is lodged on that very basis on 30.04.2015 without giving any explanation. Further submission is that petitioner has no criminal antecedent and is in custody since 26.02.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Sasaram, Rohtas in connection with Sasaram (Town) P.S. Case No. 481 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
