The petitioner seeks bail in connection with Haspura P.S. Case No. 34 of 1994 registered for the offences punishable under Sections 394, 302, 411 of the Indian Penal Code. First Information Report is against four unknown persons who have committed robbery in the jewelry shop of the informant and further they shot the father of the informant who later on succumbed to the injuries.
Submission is of false implication and that the petitioner is not named in the first information report, nothing has been recovered from conscious possession of the petitioner, he is suffering in custody since 18.02.2016 but has not bee put on test identification parade, other co-accused have already been allowed bail and are facing trial.
Patna High Court Cr.Misc. No.21962 of 2016 (3) dt.01-07-2016 Learned APP submits that this is a case of the year 1994 and petitioner remained absconding since then. In the facts and circumstances stated above, considering that the petitioner remained absconding since long, at present, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected. Let the trial be expedited and concluded as early as possible, preferably within six months from the date of receipt/production of a copy of this order.
