JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 06-09-2017 Heard learned counsel for the petitioners, State and the State Election Authority.

2. The petitioner has moved the Court for the following relief:

"That this writ application is being filed by the petitioner for issuance of Mandamus directing the Respondent No. 6 to issue fresh voter list after correcting the same for adding 585, who are share holder member and further issued

Patna High Court CWJC No.10483 of 2017 (2) dt.06-09-2017 2/2 direction to add the name from serial No.

1342 to 1927 in final voter list as per letter No. 17 dated 13.1.2017 issued by the Respondent N.

and further issued appropriate writ/writs, order/orders, direction/ directions as your Lordships may deem fit and proper in the interest of justice."

3. Learned counsel for the State Election Authority raised a preliminary objection and submitted that the writ petition has been filed after the election has already been held on 11.07.2017.

4. Faced with the situation, learned counsel for the petitioners submitted that the writ petition be disposed off with liberty to the petitioner to assail the election before the appropriate forum.

5. In view thereof, the writ petition stands disposed off with liberty aforesaid.

6. If the petitioner moves before the appropriate forum with regard to the election in question within one month from today, the same shall be considered and disposed off on merits expeditiously and latest within a period of six months from the date of filing such application.
