JUSTICE PRABHAT KUMAR JHA ORAL ORDER 06-08-2015 Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned Additional Public Prosecutor.
The petitioner seeks bail in a case under Section 307 and other sections of the Indian Penal Code.
The informant alleged that petitioner, Sangita Devi, Bitu Kumar and Beauty Kumari assaulted his three daughters, Puja Kumari, Jyoti Kumari and Archana Kumari with sharp edged weapon.
It is submitted that there is a counter version. Two daughters of the informant got simple injury. Jyoti Kumari got grievous injury on her head but the injury is opined to be caused
Patna High Court Cr.Misc. No.28696 of 2015 (2) dt.06-08-2015 2/2 by hard and blunt object. The petitioner and others are alleged to have assaulted with sharp edged weapon. Nothing has been stated that who gave the blow causing fracture injury on the head of Jyoti Kumari.
The learned counsel for the informant, on the other hand, vehemently opposed the prayer for bail and has submitted that it was the petitioner who assaulted the three daughters of the informant but it appears from the FIR itself that omnibus and general allegation of assault is made against four persons. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Dr. D. N. Bhardwaj, learned Judicial Magistrate, 1st class, Siwan in Raghunathpur P.S. Case No. 223/ 2014.
