The petitioner is accused in connection with Silao P.S. Case No.76/2015 registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code.
The accusation is that the petitioner along with his two sons and nephew came at the door of the informant having lathi, stick and sword in their hand and started abusing and in that course at the instance of the petitioner, his both sons namely Nitish Kumar and Satish Kumar started to cause assault through lathi and sword, due to which the informant received head injury and when the son of the informant came to rescue, he was also
Patna High Court Cr.Misc. No.19771 of 2016 (2) dt.12-05-2016 assaulted by them and he became unconscious and fell down. The cause of occurrence is said to be the partition of land. Learned counsel for the petitioner submits that the petitioner and informant are full brothers and no overt act has been alleged against the petitioner. Further submission is that the specific allegation is against co-accused Satish Kumar and Nitish Kumar and not against this petitioner.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S.
