JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 0902-2016 in a case registered under Sections-302/34 of the Indian Penal Code and under Section-27 of the Arms Act. It is stated that the petitioner caught hold the deceased but according to prosecution case itself, it was co-accused Chhotu Sharma, who shot fire upon the deceased. Moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail and the alleged occurrence is alleged to have been place on account of land dispute.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner
