JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Supplementary affidavit is filed on behalf of the petitioner Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report being the mother of co-accused Nihal Singh against whom there is allegation that he along with his other friends kidnapped informant's minor daughter, who is still traceless. Admittedly, petitioner is mother of co-accused Nihal Sing and the allegation of kidnapping is not against the petitioner. The impugned order shows that in course of investigation, the location of mobile phone of co-accused Nihal Singh was found

Patna High Court Cr.Misc. No.19976 of 2016 (2) dt.06-05-2016 2/2 near his maternal home and, therefore, it can only be assumed that the petitioner was aware about the occurrence of kidnapping and after the aforesaid kidnapping, the petitioner had given shelter to the co-accused Nihal Singh. Petitioner is in jail custody since 09.02.2016 and the investigation against the petitioner has been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur in connection with Nathhnagar (Lalmatiya) P.S.Case No. 32 of 2016/G.R. No.287 of 2016.
