JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Suryapura P. S. Case No. 134 of 2018, disclosing offences under Sections 420 and 406 of IPC. As per F.I.R. there is allegation against the petitioner is of demand of Qwid Car from the informant on the plea of dropping his father, but later on, he has not returned the said vehicle and when he asked about the same, he has assaulted him.

Submission of the learned counsel for the petitioner is that as a matter of fact, there was an agreement for purchase of the vehicle, for which, he has given Rs. 75000/- in the account of Mediator, namely, Manish Kumar and Rs.8000/- was transferred in the account of the informant, but the present case has been lodged against the petitioner.

Patna High Court CR. MISC. No.3576 of 2020(2) dt.21-01-2020 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there is no chit of paper that the amount was given to the informant.

Having heard both sides, in view of the submissions made above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail. With the aforesaid, this application is dismissed. (Vinod Kumar Sinha, J) Rahul/- U T
