1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Baikunthpur P.S. Case no. 337 of 2024, registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, it is alleged that having received information that the petitioner was involved in the sale of liquor behind his house, a raid was conducted. Seeing the police personnel, he fled away. On search a total of about 15 litres of liquor was recovered.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered either from the possession or from the house of the petitioner nor from behind his house. He has been falsely implicated in the case at the

Patna High Court CR. MISC. No.6231 of 2025(2) dt.24-02-2025 2/2 instance of the Mahal Chowkidar who is on inimical terms with the petitioner. He has no criminal antecedent and undertakes to cooperate in the case.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the petitioner not having been arrested at the spot nor any incriminating article having been recovered from his possession or from inside his house, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Baikunthpur P.S. Case no. 337 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions JudgeXIII-cum-Special Excise Court no.-I, Gopalganj.
