Petitioner is accused in connection with G.R.P. (Patna Junction) Case No. 14 of 2016 registered under Sections 379/411/414/34 of the I.P.C.
The accusation is that the informant reached at Patna Junction but due to late night he slept at waiting room, where two persons reached and also slept near him. Out of them, one person took cash Rs. 430/- and his mobile phone from his pocket and handed over to other associate. When he woke up then he found the mobile phone and cash are not in his pocket. At that time, both persons who were slept near him started to flee away but both were apprehended, who disclosed their name petitioner Chandan
Patna High Court Cr.Misc. No.19659 of 2016 (2) dt.10-05-2016 2/2 Kumar and co-accused Rakesh Mahto. On search, cash and mobile phone were recovered from the possession of Rakesh Mahto. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the alleged mobile and cash, which are said to have been stolen, have not been recovered from the possession of this petitioner. It is also submitted that petitioner has no criminal antecedent and is in custody since 28.01.2016 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of R.J.M., Patna in connection with G.R.P. (Patna Junction) Case No. 14 of 2016. Out of two sureties, one surety must be parents or close relatives of the petitioner.
