The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,341,323,324,307,379,504 and 506/34 of the IPC. The prosecution case as per the written report of Ramavtar Sahani submitted to the SHO, Pipra Police Station is to the
Patna High Court CR. MISC. No.4656 of 2020(2) dt.29-02-2020 2/3 effect that on 24.7.2019 at about 5.30 P.M. the informant was returning home from market when eight accused persons including the petitioners made assault and snatched articles. It is specifically alleged that petitioner Ganganath Sahani assaulted Laxman Sahani with Farsa, petitioner Harikishun Sahani assaulted Ramautar Sahani with iron rod and petitioner Rajesh Sahani assaulted with lathi to Dasai Sahani. It is submitted by learned counsel for the petitioners that the injuries have been found simple and there is counter version of the occurrence being Pipra P.S. Case No. 262 of 2019 filed by petitioner Ganganath Sahni against the informant's side. Statement has been made in paragraph 3 of the petition that the petitioners except petitioner no. 1 who is accused in one another case, are not having any criminal antecedent. Learned APP submits that there are specific accusation against the petitioners in the FIR.
Considering the genesis of the occurrence, nature of injury being caused, there being counter version of the occurrence let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing
