The petitioner seeks bail in Kotwali P.S. Case No. 553 of 2014, registered for the offences punishable under Section 302 of the Indian Penal Code and under Section 27 of the Arms Act. The sister of the deceased disclosed that her brother Md. Alam was killed by unknown persons.

It is submitted that during the course of investigation, name of the petitioner figured in the case in the confessional statement. Some of the witnesses have also been examined who are hearsay witnesses. Similarly situated co-accused Md. Shah Alam @ Md. Alam @ Alam and Md. Akbar @ Akbar have already been enlarged on bail vide order passed in Cr. Misc. No. 4172 of 2015 and Cr. Misc. No. 6641 of 2015. The case of the

Patna High Court Cr.Misc. No.20748 of 2015 (2) dt.18-06-2015 2/2 petitioner stands on the same footing.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kotwali P.S.
