The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 37(b) and (C) of the Bihar Prohibition and Excise Amendment Act, 2018 The allegation against the petitioner and other accused persons is that under the influence of intoxication and in that state, attacked on the vehicle of the informant and damaged the same.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has not been apprehended at the spot and only allegation against the petitioner is that he only consuming the liquor. Petitioner has got clean antecedent.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Excise Court, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 460 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
