The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 141 of 2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

86 litres of liquor is said to have been recovered from a Tempo vehicle from where the petitioner is said to have run away. His name was supplied by the villagers.

Patna High Court CR. MISC. No.15680 of 2021(2) dt.07-01-2022 2/2 However, since the petitioner has earlier been made accused in a case of similar nature, I am not inclined to grant anticipatory bail to him.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, that shall be considered on its own merits, taking into account the afore-stated facts and an order shall be passed, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
