The petitioner is languishing in custody since 23.05.2015 in connection with Sessions Trial No. 03 of 2016, arising out of Paraiya P.S. Case No. 42 of 2015 for the offences instituted under Sections 353, 307, 414 of the IPC and 25(1-B)a, 26 and 27 of the Arms Act.
The prosecution story, in brief, is that one country made pistol and three live cartridges are said to have been recovered from possession of the petitioner and others. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.05.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. As per the prosecution case, one country
Patna High Court Cr.Misc. No.18198 of 2016 (3) dt.25-05-2016 2/2 made pistol alongwith three live cartridges are said to have been recovered from possession of the petitioner and others. No compliance of Section 100 Cr. P.C. has been carried out. The other co-accused have been granted bail by this Court vide Cr. Misc. No. 42786 of 2015.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-Ist, Gaya, in connection with Sessions Trial No. 03 of 2016, arising out of Paraiya P.S.
