2. The petitioner has prayed for bail in connection with K. Hat (Sahayak) P.S. Case No. 1351 of 2023 registered for the offence punishable under Section 306 and 34 of the Indian Penal Code.

3. The case of the prosecution is that Rohit and Shweta solemnized marriage and the same was court marriage. It is alleged that the deceased Nitish helped them in solemnizing marriage. It is further alleged that he was being threatened by the accused persons due to which, he committed suicide.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the nature of allegation is general and omnibus. From

No.6231 of 2026(2) dt.06-02-2026 2/2 perusal of the order of the learned trial court, it transpires that the name of this petitioner has been maliciously dragged into this case solely on account of his relationship as the father of Sweta Kumari, within whom the friend of the deceased had solemnized marriage. He also submits that co-accused namely, Sudhanshu Bhagat has already been granted bail by this court vide Cr. Misc. No. 82081 of 2025. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 17.11.2025.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Sahayak) P.S. Case No. 1351 of 2023.
