JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1678 of 2017, SC No. 1226 of 2018, in which cognizance has been taken under Section 498A IPC and Section 4 of Dowry Prohibition Act. Allegation against the petitioner is of assaulting and ousting his wife, complainant, from his house with respect to demand of Rs.2 lacs.

Submission of learned counsel for the petitioner is that as per complaint petition itself it is a case of love marriage and the petitioner has kept her at Delhi but she fled away and filed the present case making allegation against the petitioner

Patna High Court CR. MISC. No.6365 of 2019(4) dt.17-04-2019 2/2 and the petitioner is still ready to keep her with dignity and care. Notice was issued to opposite party No.2 but in spite of valid service of notice she has not appeared and on the last date also none had appeared on behalf of opposite party No.2. Heard learned APP also.

In the facts and circumstances, the provisional bail granted to the petitioner vide order dated 5.2.2019 is, hereby confirmed in connection with Complaint Case No. 1678C of 2017, SC No. 1226 of 2018, pending in the court of SubDivisional Judicial Magistrate, West Champaran, Bettiah.
