2. Heard learned counsel for the appellant/s and learned Spl. P.P for the State is present. No one appears on behalf of the Informant.

The present Appeal has been filed for grant of anticipatory bail against the order dated 13.11.2024 passed by the learned Exclusive Special Judge (SC & ST), Patna in ABP No. 4124 of 2024 which was rejected in connection with Athmalgola P.S. Case No. 257 of 2024 registered for the offence under sections 126(2), 115(2), 329(4), 74, 109(1), 3(5) of the BNS Act and Section 3 (1)(r)(s) of the Scheduled Castes and

Patna High Court CR. APP (SJ) No.370 of 2025(4) dt.12-11-2025 2/3 Scheduled Tribes (Prevention of Atrocities) Act.

4. As per the FIR, allegation against the petitioners is that he along with the other accused persons has assaulted and abused the informant and his family members by their caste name.

5. Learned counsel for the appellant submits that appellant is innocent and has been falsely implicated in this case. He further submits that appellant is lady and she is simply a victim of false implication in this case due to dirty village politics. He further submits that scuffling took place inside the house of the victim and not within the public view so no case under SC & ST act is made out against the appellant as there was a land dispute going on between them. He further submits that there is case and counter case between the parties i.e., Athmalgola P.S. Case No. 253 of 2024 is filed by the appellant. He further submits that FIR has been lodged after the delay of four days and for this delay, no plausible explanation has been given. He further submits that appellant possesses clean antecedent.

5. Learned Spl.P.P. opposes the prayer for anticipatory bail.

6. On perusal of FIR and impugned order dated

Patna High Court CR. APP (SJ) No.370 of 2025(4) dt.12-11-2025 3/3 13.11.2024, it appears that there is case and counter case between the parties and the scuffling took place inside the house of the informant and not within the public view. Moreover, there is no specific allegation made out against the appellant rather it is on other accused person. So, let the above named appellant be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (SC & ST), Patna in connection with Athmalgola P.S. Case No. 257 of 2024 as per the condition laid down under Section 482(2) of the BNS. (Ramesh Chand Malviya, J) Sunnykr/- U
