JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 01.12.2015 in a case registered for the offences punishable under Sections 20 and 22 of the Indian Penal Code and Section 25(1-B)a, 24 and 35 of the Arms Act.
From the possession of the petitioner 4 kg ganja, one country made pistol and one live cartridge were recovered. It is submitted by learned counsel for the petitioner that investigation has already completed. The petitioner was never been accused in any case under NDPS Act, though, he is accused in one other case being Hajipur Town P.S. Case No. 1126 of 2014 registered under Sections 394, 395 and 412 of the IPC, statement to that effect has been made in para 3 of the petition. It is further submitted that the petitioner is on bail in earlier case, though,
Patna High Court Cr.Misc. No.22006 of 2016 (3) dt.23-06-2016 2/2 statement to that effect has not been made in the petition. Learned APP does not controvert the contention of the petitioner.
Considering the quantity of recovery of ganja and period under custody, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge cum Special Judge, NDPS Act, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 847 of 2015.
Learned trial court will be at liberty to cancel the bail bonds of the petitioner if he defaults for three consecutive occasions or gets involved in similar nature of offences. (Dinesh Kumar Singh, J) Amrendra/- U T
