The petitioner seeks bail in a case instituted for the offences under Sections 467, 468, 420 and 471 of the Indian Penal Code..

The prosecution case in short is that the accused persons deposited a fake draft in the bank account and thereafter fraudulently withdrawn certain sum from the bank. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.8.2018 and has got no criminal antecedent. There is no allegation of tampering of

The petitioner has falsely been implicated in the present case. The withdrawl of Rs. 1,80,000/- has been made by the petitioner is denied. It is further submitted on behalf of the petitioner for the purpose of bail, the petitioner will deposit an amount of Rs. 50,000/- at the time of furnishing of the bail bonds and the balance amount of Rs. 1,30,000/- will be deposited within three months from the date of release on bail which will be subject to the final disposal of the case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, on deposit of a sum of Rs. 50,000/- in the Court below which will be subject to final disposal of the case, it is directed that the petitioner, above named, be released on provisional bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VII, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 458 of 2012.

It is further directed that the petitioner will deposit remaining Rs. 1,30,000/- within three months of his release in the Court below which will be subject to final disposal of the

It is further directed that if the petitioner deposits a total amount of Rs. 1,80,000/- within the aforesaid time, the provisional bail granted to the petitioner will be confirmed by the Court below itself.

If the petitioner fails to deposit total amount of 1,80,000/- as per terms mentioned above, the Court below will cancel the provisional bail granted to the petitioner and issue process against the petitioner for his production. (Sudhir Singh, J) Pankaj/- U T
