JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Nardiganj P.S. Case No. 167 of 2015 registered under Sections 341, 323 and 504/34 of the Indian Penal Code, Sections 3(i)(x) of SC/ST (Prevention of Atrocities) Act and Section 27 of the Arms Act. The accusation of informant is that on 30.11.2015, he was going to shop for purchasing of Airtel Coupon, in the way, four persons including the petitioner started to abuse and assault him. On raising alarm, when Sanjay Manjhi came to save him then he was also assaulted by the accused persons. At that time, all accused persons named in the F.I.R. including the petitioner opened fire in order to create terror.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.20843 of 2016 (2) dt.19-05-2016 petitioner has falsely been implicated in this case due to ulterior motive. Moreover, no injury was found on the person of the informant. It is further submitted that petitioner is accused in one other case, in which, he is on bail and is in custody since 17.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Nawada, in connection with Nardiganj P.S. Case No. 167 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
