JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although after investigation police submitted charge sheet under section 306 and 201 of the Indian Penal Code against the petitioner but in course of investigation, it came to light that the marriage of the deceased had taken place three years ago and she died other than in normal circumstance and furthermore, the informant as well as his other family members specifically stated that deceased was subjected to cruelty and harassment due to non fulfillment of demand of dowry.
Considering the aforesaid facts and circumstances, I am not inclined to release the petitioner on bail and accordingly his prayer for bail in connection with Fatehpur P.S.Case No. 16 of
Patna High Court Cr.Misc. No.27917 of 2015 (3) dt.13-10-2015 2/2 2014, pending in the court of learned Judicial Magistrate 1st class, Gaya / concerned court stands rejected, at least, at this stage. (Hemant Kumar Srivastava, J) Namita/- U T
