JUSTICE JITENDRA KUMAR ORAL ORDER 18-03-2025 The present petition has been preferred under Section 483(3) of the B.N.S.S., 2023 for cancellation of the impugned order dated 11.12.2024 passed by this Court in Cr. Misc. No. 84901 of 2024 whereby Md. Nadeem, Opposite Party No. 2 herein, has been granted anticipatory bail.
2. Heard learned counsel for the petitioner.
3. Learned counsel for the petitioner submits that after getting released on bail, the Opposite Party No. 2, Md. Nadeem is misbehaving and abusing the petitioner/wife, Zeenat Siddiqi. However, learned counsel for the petitioner admits that so far, no FIR or complaint has been lodged against Md. Nadeem, Opposite Party No. 2 herein subsequent to his release
Patna High Court CR. MISC. No.6760 of 2025(4) dt.18-03-2025 2/2 on bail. At present, he has no documentary evidence that Opposite Party No. 2, Md. Nadeem, has misused his bail.
4. At this stage, learned counsel for the petitioner is seeking permission to withdraw the present petition with liberty to re-file similar application if any FIR or criminal complaint is lodged against Opposite Party No. 2 in view of his criminal misconduct.
5. Permission is accorded.
6. Accordingly, the present petition is dismissed as withdrawn with aforesaid liberty.
