The petitioner seeks bail in a case for the offences punishable under sections 461 and 379 of the I.P.C The prosecution story, in brief, is that when the informant after keeping Rs, 3,35,000/- in dikky of his motorcycle has gone to purchase a bag and when returned the said amount was snatched by the unknown culprits and fled away. On behalf of the petitioner it has been submitted that the petitioner is in custody since 24.3.2015. Charge sheet has been submitted in the case. It is further been submitted that the petitioner has been made accused due to mistake of fact. The petitioner is not named in the F.IR. The petitioner has got no
Patna High Court Cr.Misc. No.27082 of 2015 (2) dt.28-07-2015 2/2 criminal antecedent. It is also submitted that the petitioner may be released after completion of six months in custody. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on completion of six months in custody from 24.3.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Gopalganj in Mirganj P.S. Case No. 169 of 2014.
