Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, his name surfaced in this case when the victim was recovered and her statement was recorded under section 164 of the Cr.P.C., which has been annexed as AnnexureA to the supplementary affidavit. Learned counsel for the petitioner points out that the victim has very clearly stated in her statement recorded under Section 164 Cr.P.C. that she was never kidnapped and, as a matter of fact, she left her home in anger and went to the house of her
