JUSTICE RAJIV ROY ORAL ORDER 21-04-2025 Learned counsel for the petitioner prays for and is allowed to implead the Arbitrator cum Divisional Commissioner, Magadh Division, Gaya as respondent no.6 in course of the day.

2 Heard the parties.

3. The present petition has been preferred for the following relief/s:

(i) for issuance of an appropriate writ/ writs, order/ orders, direction/ directions, commanding and directing the respondent authorities, specially the respondent no 4

Patna High Court CWJC No.9353 of 2017(2) dt.21-04-2025 2/3 the Special Land Acquisition Officer, Sone Project Aurangabad to pay the compensation amount at the rate of 4 times of the circle rate of the land fixed by the government in respect of the land of the petitioner along with statutory interest which has been acquired by the respondent authorities under sone project for construction of the Nasirna Minor Canal as the farmers of other villages have been paid compensation amount at the rate of 4 times of the circle rate but the petitioner has been paid below at the rate of circle rate. The petitioner further prays for any other relief/ reliefs for which he may be found entitled in the facts and circumstances of the present case.

4. A counter affidavit has been filed on behalf of respondent no.4 then Special Land Acquisition Officer, Aurangabad detailing out that after sanction of revised estimate, the petitioner received Rs. 1,59,662/- on 11.04.2017 and as such he has already been paid appropriate compensation.

5. The rejoinder of the petitioner shows that he still entitled to some amount.

6. Learned counsel for the petitioner submits that he shall be approaching the newly added respondent, the Arbitrator cum Divisional Commissioner, Magadh Division, Gaya for the redressal of the grievance.

7. If such petition is preferred by the petitioner, the same be taken to its logical conclusion.

8. Needless to say that if the respondent come to a conclusion that the petitioner still has some case, an appropriate order be passed.

8. With the aforesaid observation, the writ petition stands disposed of.
