The petitioner seeks bail in Barharia P.S. Case No. 313/2013, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. Later on Section 302 was added.

While Ali Hussain, son of the informant was going to market, the petitioner along with other accused persons caught him. Sufian is said to have caught him and Md. Moin Akhtar @ Md. Moin is alleged to have stabbed Ali Hussain. Md. Moin Akhtar has already been enlarged on bail vide order dated 21.07.2014 passed in Cr. Misc. No. 18850/2014.
