The petitioner seeks bail in a case under Sections 399 and 402 of the Indian Penal Code and different sections of the Arms Act.

The informant, S.H.O. of Siwan Police Station, got information that many criminals had assembled at the darwaja of Bijendra Kumar Singh @ Guddu Singh and they were conspiring to commit some crime after taking wine. Chandan Singh was apprehended whereas Guddu, Rupesh, Dharmendra, Suchit and others fled away after throwing their arms. It appears that one loaded pistol with live cartridges were recovered from the vehicle parked near the house.

It is submitted that nothing has been recovered from the

Patna High Court Cr.Misc. No.21536 of 2015 (2) dt.18-06-2015 possession of the petitioner. The vehicle of course stands in the name of the petitioner on which one loaded pistol was recovered. Other accused persons, namely, Dharmendra Singh, Bijendra Kumar Singh @ Guddu Singh, Gajendra Mohan Singh and Suchit Singh have been enlarged on anticipatory bail. Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Siswan P.S.Case No. 01 of 2015.
