2. The present writ petition has been filed for quashing the order bearing Memo No. 1772 dated 06.06.2017 issued under the signature by the Sub-Divisional Officer-cum-Licensing Officer, Gogri whereby and whereunder he has cancelled the P.D.S. License of the petitioner bearing its No. 14P/2007.

3. At the very outset, learned counsel for the petitioner fairly accepts that a right of statutory appeal is available against the impugned order before the Collector, Khagaria.

4. In the above view of the matter, this Court is not inclined to enter into the merits of the matter. The writ petition is disposed of with liberty to the petitioner to prefer an appeal against the impugned order for redressal of his grievances.

5. It is made clear that in case such an appeal is filed, the concerned authority would have regard to the preset proceeding being pursued by the petitioner while considering any issue relating to condonation of delay, if applicable.
