====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Taraiya P. S. Case No. 60/2023 in a case registered for the offences punishable under Sections 363, 323, 504, 506/34 of the Indian Penal Code.
3. As per prosecution case, sister of the informant was married to one Kamlesh Ram on 7.06.2018. After the death of Kamlesh Ram, due to lightening, Government sanctioned Rs. 4 lacs for the victim and before the cheque could be cleared, the victim went missing on 13.2.2023. It is alleged that all the F.I.R. named accused persons, in order to grab the aforesaid amount, abducted the sister of informant.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner
Patna High Court CR. MISC. No.4552 of 2025(4) dt.02-05-2025 2/2 transpired during course of investigation in confessional statement of the victim recorded under Section 164 Cr.P.C as well as under Section 161 Cr.P.C. wherein, she stated that the accused persons sold her in Jaipur. He further submits that there is no allegation of sexual assault. Victim has already been recovered. F.I.R. has been lodged after inordinate delay of thirteen days for which there is no plausible explanation. Petitioner is in custody since 23.06.2024. Petitioner claims clean antecedent. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the nature of accusation, statement of the victim recorded under Section 164 Cr.P.C. and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge I, Saran in connection with Taraiya P. S. Case No. 60 of 2023.
