JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-05-2016 The petitioner apprehends arrest in a case under section 406 of the Indian Penal Code.

The allegation is that the petitioner took a sum of Rs. 2 lacs for which he signed an agreement dated 12.4.2012 and now he is not returning the same with an ulterior motive. The petitioner submits that in fact the complainant had taken Rs.52,000/- from his (petitioner) sister Shanti Kumari, and to grab the same, the petitioner has lodged this case. In the facts and circumstances of the case, if the petitioner as mentioned above surrenders within six weeks and prays of regular bail, the same would be disposed of on its own merit without prejudice, preferably on the same day. It will be open for the parties to arrive at a compromise in the meantime.
