Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant.

This application for grant of regular bail in Special Case No. 16 of 2018 arises out of Bihta P.S. Case No. 69 of 2018 registered for the offences punishable under Sections 366 and 376(G) of the Indian Penal Code and Section 3, 8 and 12 of the POCSO Act.

No.16543 of 2021(3) dt.26-05-2021 2/3 The petitioner's application for grant of regular bail was earlier rejected thrice by orders dated 22.11.2018, 27.06.2019 and 04.06.2020 passed in Cr. Misc. No. 65481 of 2018, Cr. Misc. No. 39092 of 2019 and Cr. Misc. No. 76086 of 2019. It is the forth attempt of the petitioner to seek regular bail. It was indicated in the order dated 04.06.2020 that if the trial was not concluded within six months, the petitioner shall be at liberty to renew his prayer for bail. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner is in custody for nearly three years and for the alleged occurrence said to have taken place on 21.11.2017, an F.I.R. was registered on 24.01.2018.

Learned counsel appearing on behalf of the informant has submitted that the petitioner is threatening the informant and coercing the witnesses to influence the trial. He has further submitted that the informant has forcibly obtained informant's signature on an application for closing of the prosecution.

Be that as it may, considering the facts and circumstances of the case and the petitioner's continuous custody, this application is allowed.

No.16543 of 2021(3) dt.26-05-2021 3/3 Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge 1st Patna in Special Case No. 16 of 2018 arises out of Bihta P.S. Case No. 69 of 2018.
