JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 It has been submitted that petitioner no.4 has been arrested during pendency of this application. In view of that this application against petitioner no.4 is dismissed as withdrawn. So far other petitioners are concerned, this is an application for grant of anticipatory bail in connection with Sursand P.S. Case No. 98 of 2018, disclosing offences under Sections 447, 341, 323, 324, 307, 354, 379, 504/34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the

Patna High Court CR. MISC. No.6904 of 2019(3) dt.03-04-2019 2/2 informant and others and there is specific allegation of assault is against petitioner no.2 by farsa on the head of the informant. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and injuries are simple in nature.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Pupri at Sitamarhi, in connection with Sursand P.S. Case No. 98 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
