Learned counsel for the petitioner undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b) (a), 26 (i), 35 of the Arms Act. Earlier, prayer for bail of the petitioner was rejected on the ground of suppression of criminal antecedent. Patna High Court CR. MISC. No.5534 of 2022(2) dt.16-02-2022 2/2 accused has been granted bail vide order dated 12.01.2022 in Cr. Misc. No. 70563 of 2021. He further submits that petitioner has six criminal antecedent and he is languishing in judicial custody since 29.08.2020.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Dharahara P.S. Case No. 137 of 2020 pending before the court of the learned 7th Additional Sessions Judge, Munger. However, petitioner is at liberty to renew his prayer for bail after framing of charge.
