2. Learned counsel for the petitioner is permitted to make necessary correction in the prayer portion.

3. Permission is accorded.

4. The petitioner seeks bail in connection with Bihar P.S. Case No. 355 of 2018 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act.

5. As per the prosecution case, the criminals were caught planning a loot and the petitioner was not caught on the spot.

6. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

Patna High Court CR. MISC. No.9798 of 2024(2) dt.20-02-2024 2/2 case. Learned counsel further submits that except the confessional statement of co-accused, no material has come to connect the petitioner with the crime. The petitioner is in jail since 12.10.2023.

7. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

8. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 355 of 2018.

9. The petitioner will also mark attendance in Islampur Police Station, Nalanda on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
