Petitioner seeks bail in a case registered for the offences punishable under Sections 395/397 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act. The FIR of the occurrence of dacoity is against 25 to 30 unknown persons. It is disclosed that the accused persons were in between age group of 25 to 40 years. Petitioner is aged about 60 years. Petitioner is in custody since 03.11.2018. Investigation of the case is complete.

Submission is that petitioner was never put on Test Identification Parade nor anything was recovered from his possession. Only material against the petitioner is his criminal antecedents which led to implication in the present case.

No.5638 of 2019(3) dt.22-04-2019 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kanti Police Station Case No. 682 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
