2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Begusarai Muffasil P.S. Case No. 353 of 2024 registered for the offence under Section 103(1) of the Bharatiya Nyaya Sanhita.
3. In this case, the name of the deceased is Kanhaiya Kumar. On 04.10.2024, his dead body of the deceased was lying found on a road near his bicycle. The matter was reported by brother of the deceased wherein it is alleged by him that some unknown persons gave some poisonous substance, due to that his father has died. On the basis of that, the aforesaid offence is registered and during course of investigation, the present
Patna High Court CR. MISC. No.7668 of 2025(3) dt.08-05-2025 2/3 applicant has been arrested on 13.11.2024 and since then he is in custody.
4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case. There is no legal evidence available on record on the basis of which he can be implicated for the alleged crime. Further, he submits that petitioner is in custody since 13.11.2024. He has no criminal antecedent, therefore, on these grounds, it is prayed that the petitioner may be granted benefit of bail.
5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

7. Perused the case diary and materials available on record.
8. After perusal of the case diary without commenting on merits of the case, I am of the view that it is a case where the petitioner should be granted benefit of bail.
9. Accordingly, the application is allowed.
10. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M.,
