The grievance of the petitioner is now confined to the extent what is protected by the order of the Apex Court in the case of Durga Prasad Singh & Ors Vs. State of Bihar & Ors (Civil Appeal No(S) 6178-6181 of 2015) as contained in Annexure-4.
The decision of the Apex Court in Durga Prasad Singh (supra) is applicable to all similarly circumstanced and if
Patna High Court CWJC No.13063 of 2017(2) dt.18-02-2020 2/2 the case of the petitioner is covered by the aforesaid decision, the benefit in terms of Annexure-4 shall be extended to this petitioner also.
The respondents are directed to take appropriate decision in terms of the order of the Apex Court in Durga Prasad Singh case (supra) within a maximum period of four months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ application stands disposed of.
