The petitioner, who is in custody since 04.09.2019, seeks bail in connection with Bhagwan Bazar P.S. Case No. 358 of 2019 dated 31.07.2019 instituted for the offence under Section 392 of the Indian Penal Code.

The informant was waylaid by three unidentified persons and was looted of his belongings. The FIR therefore, was registered against three unknown persons. Subsequently those persons were identified in the CCTV footage as Deepak Ray, Deepak Mahto and Roushan Kumar. The name of the petitioner has transpired in the confessional statement of one Deepak

Patna High Court CR. MISC. No.5129 of 2020(5) dt.29-05-2020 2/2 Mahto. Apart from this, one witness has stated that the petitioner was seen moving at the place of occurrence. Apart from the aforementioned materials, there is no other evidence to connect the petitioner with the offence. The three other cases in which the petitioner has been made accused in the past, about which reference has been made in paragraph 3 of the case diary, he is on bail in all of them. After the petitioner was remanded in this case he has further been remanded in four other cases which fact has been mentioned in paragraph No. 12 of the bail petition. Considering the aforestated facts the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 358 of 2019.
