JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code.

One sharp edged weapon is said to have been recovered from conscious possession of the petitioner when he along with others had assembled to make preparation for committing dacoity and for the aforesaid act, petitioner is in jail custody since 30.01.2016. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.19890 of 2016 (2) dt.06-05-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in connection with Rupaspur P.S. Case No. 23 of 2016.
