The petitioner is accused in connection with Rupaspur P.S. Case No. 23 of 2016, registered under Section 399 and 402 of the Indian Penal Code.
The accusation is that Police on receiving secret information about gathering of the miscreants for making preparation to commit dacoity. Thereafter, Police reached near Haridaspur Kali Mandir then miscreants started to flee away, but on chase six persons, including the petitioner were apprhended. On search, petitioner was found in possession of one sharp iron rod and one mobile. The petitioner having no criminal antecedent is in custody since 30.01.2016.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.20680 of 2016 (2) dt.16-05-2016 2/2 petitioner is innocent and he has falsely been implicated in this case. The petitioner is in custody since 30.01.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Danapur in connection with Rupaspur P.S. Case No. 23 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
