JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2019 This is an application for grant of anticipatory bail in connection with Sahebganj P.S. Case No. 444 of 2018, disclosing offences under Sections 272, 273 of the Indian Penal Code and Sections 30(A), 36, 38(ii), 41(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is of recovery of more than 3000 liters liquor from a truck and the petitioner is said to be the driver of said truck.

Submission of learned counsel for the petitioner is that the petitioner has no knowledge about the same and he has falsely been implicated in this case. Further, he has no criminal antecedent.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.5685 of 2019(2) dt.01-02-2019 2/2 Having heard both sides, considering the facts and circumstances of the case and recovery of huge quantity of liquor, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
