Petitioner is accused in connection with S. Tr. No. 258 of 2014/472 of 2013 arising out of Tekari P.S. Case No. 169 of 2012 registered under Sections 304(B) and 201/34 of the I.P.C. Learned counsel appearing on behalf of the petitioner submits that earlier prayer of the petitioner for bail was rejected on 06.02.2014 by this Court vide Cr. Misc. No. 31174 of 2013. It is also submitted that petitioner, being husband of the deceased, has falsely been implicated in this case due to misunderstanding, while the informant, father of the deceased, participated in the funeral ceremony of the deceased, Sunita Devi, who died due to snake biting. It is further submitted that petitioner is in custody since 22.02.2013, but till today not a single witness

Patna High Court Cr.Misc. No.27181 of 2015 (3) dt.12-08-2015 2/2 has been examined.

The report, as received from the 7th Additional Sessions Judge, Patna vide Letter No. 75 dated 28.07.2015, discloses that charge has been framed on 26.02.2015 but not a single witness has been examined.

Having considered the facts and circumstances of the case and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII, Gaya in connection with S. Tr. No. 258 of 2014/472 of 2013 arising out of Tekari P.S. Case No. 169 of 2012.
